The main obligation of PCUB is to ensure the health and safety of workers and others who may be affected by the activities of the organization in so far as it makes sense. PCUB only be able to meet their legislative obligations if the people in the workplace contribute appropriate to carry out their due diligence. These people are referred to as a clerk.
Section 27 of the Act WHS thus puts an obligation to conduct due diligence on these individuals, described as clerk. This means they are required to take reasonable steps to support a culture of health and safety, accountability, and the allocation of resources and the development of appropriate policies. This due diligence requirements allows the clerk to ensure that the PCBU use and apply the resources, policies, procedures and practices appropriate health and safety while doing business or enterprise. If an officer fails to carry out the due diligence requirements, they can be held personally accountable.
